Our Litigation Services

During our collections process it may become clear that the only remaining option to recover your debt is through the courts..

If you wish to secure your debt by obtaining judgment against your debtor in the County Court (Sheriff Court in Scotland) this too can be commenced on your behalf.

As litigation is considered to be a last resort by Scott & Mears we would always discuss in advance with our client the benefits and viability of taking this course of action.

We offer a litigation service to all our clients, drawing upon our many years of experience and to minimise our clients from exposure to further costs. It must always be borne in mind that there is no guarantee of automatic debt recovery through the courts even if judgment is issued in your favour.

Scott and Mears have both legal capabilities in-house and associations with Solicitors in England, Scotland and Europe who will prepare all necessary court papers and procedures on your behalf.

Throughout the whole process we maintain active contact with your customer ensuring they fully understand the action being taken and in the hope of obtaining an out of court settlement. We manage the case all the way through to judgment and, if necessary, act to enforce the Court’s decision.

The benefit of litigating with  Scott and Mears is that you are aware of every charge and to what stage that charge will take you.  As litigation is the one time that we will request money in advance to cover disbursements, it is ALWAYS your choice as to whether or not you litigate; there are never any “nasty surprises” of large bills suddenly appearing.
